General Terms and Conditions

 

1. Scope

The following Terms and Conditions apply to all legal relationships entered into by Medien- und Filmgesellschaft Baden-Württemberg mbH and its associated companies and organisations. Counter-confirmations from customers and event participants with reference to their own General Terms and Conditions are hereby rejected. Deviations from these General Terms and Conditions are valid only if expressly confirmed in writing by MFG Medien- und Filmgesellschaft Baden-Württemberg mbH.

2. Conclusion of the Contract

The Contract comes into effect when an order and/or registration is made by the customer and this is accepted by MFG Medien- und Filmgesellschaft Baden-Württemberg mbH.

The invitation to conclude a contract takes place when the customer completes and sends the registration form provided on the Internet by MFG Medien- und Filmgesellschaft Baden-Württemberg mbH. The form is sent by clicking on “book event”. In making the booking, the customer agrees to be bound by these General Terms and Conditions.

The contract is formed when MFG Medien- und Filmgesellschaft Baden-Württemberg mbH has sent the customer a booking confirmation by email.

3. Prices and Costs

Prices for courses and events are shown for each event on the MFG Medien- und Filmgesellschaft Baden-Württemberg mbH website. Delivery costs are calculated separately where they are indicated separately. The prices indicated at the time of booking apply.

4. Due Date/Payment/Reservation of Title

The total price including all charges is due immediately upon conclusion of the contract.

Customers will receive an invoice for the corresponding participant fee after registration. The invoice must be paid by bank transfer no later than 14 days after receipt. Payment shall be deemed to have been made only when the amount shown on the invoice is credited to the account of MFG Medien- und Filmgesellschaft Baden-Württemberg mbH.

Alternatively, customers have the option of setting up a direct debit instruction to make regular payments to MFG Medien- und Filmgesellschaft Baden-Württemberg mbH (visitors from Germany only).

Cancellations must be submitted in writing to MFG Medien- und Filmgesellschaft Baden-Württemberg mbH. For cancellations up to two weeks prior to the start of an event, a handling fee of 50 euros plus VAT will be charged. For cancellations within two weeks of the start of an event, the total participant cost will be charged. The name of a replacement participant may be supplied in writing to MFG Medien- und Filmgesellschaft Baden-Württemberg mbH.

In contracts with customers, all course materials remain the property of MFG until full payment for the course is made. In contracts with businesses as defined in section 14 of the German Civil Code, all course materials remain the property of MFG Medien- und Filmgesellschaft Baden-Württemberg mbH until full settlement is made of all accounts due under the current business relationship with the customer.

5. Reduced Rates

Reduced rates available for specific price groups are shown for each event on the MFG Medien- und Filmgesellschaft Baden-Württemberg mbH website. Reductions will be given only if requested by participants at the time of purchase. No reductions can be given once the booking procedure has been completed.

Reduced tickets are only valid in conjunction with proof of concessionary status. Combining more than one reduction is not allowed. Proof of status must be presented on the day of the event together with the booking confirmation and/or entry ticket. If the proof of status does not have a photograph, an additional document with a photograph must be shown (eg passport, driving licence).

Reduced rates can be altered at any time by MFG Medien- und Filmgesellschaft Baden-Württemberg mbH. MFG Medien- und Filmgesellschaft Baden-Württemberg mbH is also entitled to limit or withdraw reduced entry tickets for certain events.

6. Liability

MFG Medien- und Filmgesellschaft Baden-Württemberg mbH is liable for damages resulting from a deliberate act or gross negligence, for damages from culpable injury to life, limb or health and for damages due to ordinary negligence resulting in a breach of an obligation essential for performance of the contract (material contractual obligation). This also applies to representatives or vicarious agents of MFG Medien- und Filmgesellschaft Baden-Württemberg mbH. Other than liability for intent and culpable injury to life, limb or health, claims for damages are limited to foreseeable damages that may typically occur. In all other cases, claims for damages against MFG Medien- und Filmgesellschaft Baden-Württemberg mbH are precluded irrespective of their legal basis. Liability according to the Product Liability Act, due to fraud or guarantee – with the exception of guarantee liability according to section 536a para. 1 of the German Civil Code, which is excluded – remains unaffected.

MFG Medien- und Filmgesellschaft Baden-Württemberg mbH does not guarantee the accuracy of the information reproduced on its website.

7. Data Protection

Customers’ personal data will be collected, processed and used in accordance with the legal provisions of the Federal Data Protection Act (BDSG) and the Telemedia Act (TMG). Further details can be found in Medien- und Filmgesellschaft Baden-Württemberg mbH’s data protection guidelines.

MFG Medien- und Filmgesellschaft Baden-Württemberg mbH is permitted to share this data with third parties contracted to carry out events, insofar as is necessary.

8. Notice

The organiser reserves the right to make changes to the content of, or persons involved in, an event. The organiser also reserves the right to cancel an event up to three days before the event is due to start.

9. Final Provisions

If an event does not take place as a result of force majeure (fire, strike, terrorism, etc.) or other circumstances beyond MFG’s control that make it difficult or impossible to provide its normal services, the participant is not entitled to a refund of the attendance fee or reimbursement for any other losses, such as travel expenses or hotel costs. No refund will be given if the participant fails to attend the event. In the event of force majeure, MFG Medien- und Filmgesellschaft Baden-Württemberg mbH shall be exempt from performing its obligations for the duration of the obstruction.

If any provision of these Conditions are or become ineffective, this shall not affect the effectiveness of the remaining Conditions. The place of jurisdiction for merchants as defined by the German Commercial Code (HGB) is Stuttgart. German law applies, to the exclusion of private international law and the UN convention on CISG incorporated into German law.
